Terms and Conditions of Parke Official
1. Introduction
1.1
These Terms and Conditions apply to the use of our Website and to the purchase of products offered through our Website.
1.2

2. Acceptance
2.1
You represent and warrant that:
(a) you are a natural person and at least 18 years of age;
(b) you are legally capable of entering into a binding agreement with us; and
(c) you are not prohibited from entering into such an agreement under any applicable law or other contractual obligation.
2.2
We reserve the right to request written proof of your ability to accept these Terms.
2.3
You further represent that:
(a) you have not been convicted of any computer or internet-related crime; and
(b) you have not previously been denied access to our products or Website.
2.4
We reserve the right to deny you access to our Website at our sole discretion where we consider it necessary or appropriate.
2.5
By placing an order, you represent and warrant that:
(a) you have carefully and completely read these Terms;
(b) you place your order solely on the basis of these Terms;
(c) any order confirmation is provided solely on the basis of these Terms; and
(d) you agree to be bound by these Terms.
2.6
If you do not agree to these Terms, you may not use the Website or purchase products.

4. Pricing
4.1
The product prices displayed on our Website include shipping costs but exclude taxes, customs duties, government charges, or similar fees ("duties unpaid and not collected").
4.2
Any customs duties, taxes, import charges, or governmental fees associated with delivery to the shipping address are the responsibility of the customer and are not included in the product price.
For deliveries outside USA, additional costs such as customs duties or import VAT may apply, as products are shipped from overseas (China).
Customs duties and import charges are not covered by us and remain entirely the responsibility of the buyer. Products are shipped on an unpaid customs basis.
The buyer acts as the importer and is responsible for paying all applicable charges and complying with the import laws and regulations of the destination country. Due to varying import regulations, we recommend that you check possible charges before placing an order.
4.3
We make every effort to ensure that all product information, descriptions, and prices displayed on our Website are accurate. However, errors may occur.
If a pricing error is identified, we will inform you as soon as possible and provide you with the option to confirm or cancel the order. If we are unable to contact you or do not receive a response, the order will be cancelled and a full refund will be issued.
4.4
We are not obliged to fulfill an order if the price displayed on the Website was incorrect, even if you have already received an order confirmation.
4.5
Prices may be changed at any time, but such changes will not affect orders that have already been confirmed.
5. Orders

All orders are subject to product availability. If a product is unavailable, we will notify you by email and refund any payments already made where applicable.
5.2
A contract is formed only once our order confirmation has been sent and applies exclusively to the products listed in that confirmation.
5.3
If your order contains multiple products, delivery may take place in separate shipments.
5.4
We reserve the right to remove products from the Website or modify content at any time.
5.5
We reserve the right to reject or cancel orders at any time, including after an order confirmation has been issued.
5.6
If we cancel an order after payment has been received, a full refund will be issued.
6. Payment

Orders may be paid for in whole or in part using discount codes issued by us.
6.3

You are responsible for providing complete and accurate payment information.

We are not responsible for the unauthorized use of your credit card, debit card, or prepaid card by third parties, even if such card has been reported stolen.

You agree not to cancel payments or initiate chargebacks.
6.8
You agree to fully indemnify us against all chargebacks, reversals, losses, costs, or damages.
7. Delivery
7.1
We will deliver your order to the shipping address provided during checkout.
7.2
Once payment has been received, we will provide you with an estimated delivery date.
7.3
If the estimated delivery date cannot be met, we will notify you accordingly.
7.4
In certain circumstances, delivery to specific locations may not be possible. In such cases, we will inform you and offer either a refund or the option to provide an alternative delivery address.
7.5
Delivery is deemed completed once the products have been delivered to the specified address.
7.6
You are responsible for:
(a) accepting and inspecting the delivery;
(b) contacting customer service if any issues arise;
(c) providing an accurate shipping address; and
(d) any additional costs arising from failed delivery attempts.
7.7
If you do not receive your products within a reasonable period after the estimated delivery date, please contact our customer service team immediately.
8. Risk and Title
8.1
The risk of loss or damage passes to you upon delivery.
8.2
Ownership of the products passes to you only once full payment has been received and delivery has been completed.
9. Cancellations and Returns
9.1
You have the right to cancel orders or return products in accordance with our Return Policy.
9.2
Returns must be made within the specified return period.
9.3
We reserve the right to reject returns that do not comply with our Return Policy.
9.4
For defective products, we reserve the right to inspect the defect before issuing a refund or replacement.

For returns of correctly supplied products, you are responsible for return shipping costs and shipping risk.
9.6
For approved returns, we will refund the purchase price of the returned products as well as the original shipping charges. Additional costs and return shipping costs will not be refunded.

Refunds will be made using the original payment method used for the purchase.

(f) delays or failure to perform our obligations due to events beyond our reasonable control, including telecommunications failures, power outages, terrorism, strikes, adverse weather conditions, computer failures, supply chain disruptions, labour disputes, or staff shortages caused by illness or injury.
24.2
We shall not be liable for loss of profits, business losses, loss of customers, savings, benefits, or any indirect, special, or consequential damages, whether foreseeable or not.

Our total direct and indirect liability under these Terms shall be limited to USD 1,000 or five times the purchase price of the product, whichever amount is lower.
24.4
Any claim must be brought within one (1) year from the event or omission giving rise to the loss or damage.
24.5
To the extent permitted by law, no personal liability shall attach to any of our employees, representatives, advisers, or associated persons.
24.6
All express or implied representations, warranties, or undertakings are excluded to the fullest extent permitted by law.
24.7
Any claim against us may only be brought in respect of a single event or omission. Multiple related or similar events shall be treated as a single event.
24.8
The liability limitations contained in this Section 24 also apply to our joint liability with third parties.
24.9
Where liability is shared, we shall only be liable for the portion attributable to our fault.
24.10
Our liability shall be reduced by the proportion for which a third party would have been responsible.
24.11
In assessing the liability of third parties, no account shall be taken of whether you are legally prevented from bringing a claim against such third parties.
24.12
These exclusions and limitations do not apply to:
(a) death or personal injury caused by our negligence;
(b) fraud or gross negligence;
(c) liability that cannot legally be excluded; and
(d) in all other cases, our liability shall be limited to the minimum extent permitted by law.
24.13
These provisions constitute a complete statement of all remedies available in connection with these Terms.
25. Indemnification
25.1
Upon request, you agree to fully indemnify us against all claims, costs, and losses arising from:
(a) a material breach of these Terms;
(b) fraud, negligence, or misconduct on your part; or
(c) your use of our Website.
25.2
We are entitled to charge you all reasonable costs incurred in connection with an indemnification claim. Such costs shall be payable upon demand.
26. Force Majeure
26.1
If a force majeure event continues for more than one week, we shall be entitled to amend or terminate these Terms.
26.2
Any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms shall be resolved by arbitration in Hong Kong.
The arbitration shall be conducted in accordance with the arbitration rules in force at the time the proceedings are commenced. The seat of arbitration shall be Hong Kong, the language of the proceedings shall be English, a single arbitrator shall be appointed, and the laws of Hong Kong shall apply.

28. Interpretation
28.1
Terms such as "Contract", "Customer", "Delivery Address", and similar expressions refer to the definitions contained in Section 28 of the English original version. These definitions shall apply equally to any translated version.
